These Terms of Service ("Terms") govern your access to and use of the VibeSwitch keyboard app and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By downloading, installing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.
Use of the Service
Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the right, authority, and capacity to enter into these Terms.
Keyboard Access
Our Service functions as a keyboard for iOS devices. To use our Service, you must grant "Full Access" keyboard permissions. We use this access solely to provide text transformation services and collect anonymous usage analytics to improve the Service.
Account and Subscription
Some features of the Service may require a subscription. Subscriptions are managed through Apple's in-app purchase system and RevenueCat. By purchasing a subscription, you agree to:
- Provide accurate, current, and complete payment information
- Promptly update your payment information if it changes
- Pay all charges at the prices then in effect for your subscription
- Comply with Apple's terms of service regarding in-app purchases
Automatic Renewal
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription through your Apple ID account settings.
Content and Conduct
Text Transformation
Our Service transforms text you input using artificial intelligence through Groq LLM API. We do not guarantee specific results or transformations. The quality and appropriateness of transformations may vary.
User Responsibilities
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to circumvent any technological measures implemented to protect the Service
- Interfere with or disrupt the Service or servers or networks connected to the Service
Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of VibeSwitch and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Third-Party Services
Our Service uses third-party services, including:
- Groq for LLM-powered text transformations
- RevenueCat for subscription management
- TelemetryDeck for analytics
Your use of the Service includes acceptance of these third parties' terms of service and privacy policies.
Limitation of Liability
In no event shall VibeSwitch, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any transformations or content generated by the Service
- Unauthorized access to or use of our servers and any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
